Before and After Shades of Light Photo contest

Official Rules

1. Eligibility: The "before and after" Shades of Light Photo contest, (the "Contest") is open only to legal residents of the fifty (50) United States including the District of Columbia and excluding Colorado who are at least eighteen (18) years old at the time of entry. Shades of Light employees and their affiliate companies as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. Subject to all applicable federal, state, and local laws and regulations. Void in Colorado and where prohibited. Participation requires entrant’s full and unconditional agreement to these Official Rules Administrator’s decisions, which are final and binding in all matters related to the Contest. Winning the prize is contingent upon fulfilling all requirements set forth herein.

3. Contest Dates:  The contest begins on October 28^th, 2010 at 5:00 a.m. Eastern Time ("ET") and ends on December 31, 2010 at 11:59 p.m. ET (the "Contest Period"). of Light's computer is the official time-keeping device for the Contest.
4. How to Enter:
   • Online: During the Contest Period, email your before and after photos, featuring Shades of Light product, with full name, a valid home address, phone & email address, to awharrison@shadesoflight.com. P.O. Boxes are not permitted.
   • By Mail: During the Contest Period, send your before and after photographs to:
     Shades of Light Before and After Contest
     4924 West Broad Street
     Richmond, VA, 23230.
     You must include your name, a valid address, telephone and email information.
     All entries must be postmarked on or before December 31, 2010. P.O. Boxes are not permitted.
5. Criterion: The judges will be critiquing photo entries based on the originality and execution of the central themes outlined in Katrina's blog (Before & After Photography Contest. Enter to win a $250 Gift Certificate.) which you can read in our "Inspired Spaces." Simply put the theme of that blog is that a room in need of a change can be transformed by keeping the key elements in place; and that small changes such as simply adding a rug and or new lighting fixtures can dramatically update the look of a room.
6. Prize: ONE (1) PRIZE: A $250 US dollar Shades of Light Gift Card. Prize is non-transferable and no substitution will be made. Winner is responsible for all taxes and fees associated with prize receipt and/or use. Decision of the judges is final.
7. Release: By receipt of the prize, the winner agrees to release and hold harmless Shades of Light and their subsidiaries, affiliates, suppliers, distributors, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Contest or receipt or use or misuse of the prize.
8. Publicity: Except where prohibited, participation in the Contest constitutes consent to use of participants name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.
9. General Conditions: Shades of Light reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor beyond reasonable control impairs the integrity or proper functioning of the contest, as determined by its sole discretion. Shades of Light reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Shades of Light reserves the right to seek damages from any such person to the fullest extent permitted by law. Shades of Light's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
10. Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest; (4) technical or human error which may occur in the administration of the Contest or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use or misuse of any prize. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Contest, provided that, if it is not possible to award another entry due to discontinuance of the Contest. No more than the stated number of prizes will be awarded.
11. Disputes: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for Virginia.(2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Virginia.
12. Entrant's Personal Information: Information collected from entrants is subject to publication by Shades of Light.
13. Winner List: Winner List requests will only be accepted after the promotion end date (listed above) and no later than February 15, 2011.
14. Name Removal Notification System: We want to communicate with you only if you want to hear from us. If you prefer not to receive direct marketing from Sponsor or from its Select Partners, or if you would like to opt out of any rental or exchange of your information with other marketers, please let Shades of Light know by emailing visitors@shadesoflight.com. Please be sure to include your full name, email address, mailing address, and specifically what information you do not want to receive. If you would like to update or correct your email address, mailing address or other contact information with Sponsor please contact us the same way. Please note that any requests to remove or update your contact information may take up to ten (10) days for your email request and 6-8 weeks to process your postal mail request.
